Article 1 – Purpose and scope
These General Terms and Conditions of Sale (hereinafter "T&C") govern the contractual relations between SASU GS GUITARSCALER (hereinafter "GuitarScaler" or "the Seller") and any natural or legal person (hereinafter "the Customer" or "the Buyer") wishing to make a purchase on the website https://guitarscaler.com.
The purchase of a product or service via this site implies full and complete acceptance of these T&C, to the exclusion of any other conditions. GuitarScaler reserves the right to modify these T&C at any time; the applicable conditions are those in force on the day of the order.
Article 2 – Products and services offered
2.1 Physical product
GuitarScaler markets the GuitarScaler sliding ruler, an educational tool allowing guitarists to master scales and improvisation.
2.2 Digital product – Jam Sessions training
GuitarScaler also offers an online training course entitled "Jam Sessions", hosted on the Tevello platform, integrated into the Shopify store. This training can be purchased alone or in addition to the physical product (bundle).
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for digital content not supplied on a physical medium, the performance of which has begun with the express prior agreement of the consumer and who has expressly waived their right of withdrawal. When purchasing the training, the Customer will be invited to give their express agreement and waive their right of withdrawal before accessing the content. Notwithstanding this legal provision, GuitarScaler applies a commercial "Satisfied or Refunded" guarantee of 14 days (see Article 8).
Article 3 – Prices
Product prices are indicated in euros (€), all taxes included (TTC), including processing and shipping costs applicable according to the destination, as displayed during the order process.
For deliveries outside the European Union, customs duties, local taxes or import fees may be required. These costs are the sole responsibility of the Customer and fall under the responsibility of the tax and customs authorities of the destination country.
The VAT applicable to sales within the European Union is managed via the OSS one-stop shop (One Stop Shop), in accordance with current European regulations. GuitarScaler reserves the right to modify its prices at any time; the applicable price is that displayed at the time of order validation.
Article 4 – Availability
Offers and prices are valid within the limits of available stock. In the event of unavailability of a product after the order has been placed, GuitarScaler will inform the Customer by email and offer either an alternative delivery time or cancellation of the order with full refund within 14 days.
Article 5 – Order
Orders are placed exclusively via the website https://guitarscaler.com. To finalize an order, the Customer must:
- Fill in their personal and delivery information
- Select the desired product(s)
- Check and validate their cart
- Choose their payment method and finalize the transaction
Validation of the order constitutes acceptance of these T&C, which the Customer acknowledges having read. A confirmation email is sent to the Customer after the order is registered.
GuitarScaler reserves the right to cancel any order in the event of incomplete information, proven fraud or force majeure, the Customer being informed by email.
Article 6 – Payment terms
Payment is due at the time of order. The accepted payment methods are:
- Credit card (CB, Visa, Mastercard) via Shopify Payments
- PayPal
- Apple Pay and Google Pay
All transactions are secured by HTTPS protocol. GuitarScaler does not store any banking data; these are processed directly by payment service providers (Shopify Payments, PayPal).
Article 7 – Delivery
7.1 Delivery zones
GuitarScaler delivers worldwide: metropolitan France, French overseas territories, European Union, United Kingdom, United States, Canada and international.
7.2 Carriers
Orders are shipped via Lettre Suivie La Poste for all destinations. GuitarScaler reserves the right to evolve its carrier partners towards Colissimo (France) and Delivengo (International), without this modifying these T&C. The Customer will be informed of the carrier used when the shipment is confirmed.
7.3 Timeframes
The shipping time is 48 working hours from receipt of payment. This period does not include transport time. In the event of delay, the Customer will be informed by email. The delivery time cannot give rise to damages.
7.4 Customer obligations
The Customer undertakes to provide accurate and complete delivery information. They must be able to prove their identity upon receipt if requested.
7.5 Package returned to sender
If a package is returned to GuitarScaler (incorrect address, prolonged absence of the recipient, refusal of delivery, etc.), GuitarScaler will contact the Customer by email as soon as possible to arrange a resend.
The conditions for covering the resend are as follows:
- Error attributable to GuitarScaler (incorrect address on our part): the resend is carried out free of charge, at the exclusive expense of GuitarScaler.
- Error attributable to the Customer (incomplete or incorrect address provided when ordering, prolonged unreported absence, unjustified refusal of delivery): resend shipping costs are charged to the Customer, namely €7.00 TTC for metropolitan France and €10.00 TTC for any other destination. These costs must be paid by the Customer before the package is shipped.
In the absence of a response from the Customer within 30 days following notification by email, GuitarScaler reserves the right to consider the order as definitively abandoned. In this case, no refund may be claimed by the Customer.
7.6 Lost or damaged packages
In the event of a package lost or damaged during transport, the Customer must contact GuitarScaler via https://guitarscaler.com/pages/contact within 14 days following the estimated delivery date. GuitarScaler undertakes to find an appropriate solution (resend or refund).
Article 8 – Withdrawal and Satisfied or Refunded guarantee
8.1 Commercial policy
GuitarScaler grants all its customers a commercial "Satisfied or Refunded" guarantee of 14 days from receipt of the order, applicable to all products (physical and digital), without justification required.
8.2 Return procedure
To exercise this right, the Customer must:
- Submit their request via the contact page: https://guitarscaler.com/pages/contact
- For physical products: return the item in perfect condition, complete and in its original packaging, at their own expense, to the address: GS GUITARSCALER, Villa Tempérance, Chemin de la Pinède, 83470 OLLIÈRES, France
- For digital products: no physical return is required
Returned items that are incomplete, damaged, used or soiled cannot be accepted and will be returned at the Customer's expense. No cash on delivery shipments will be accepted.
8.3 Refund
The refund will be made within 14 days following receipt of the return (physical product) or validation of the request (digital product), using the same payment method as that used during purchase.
Article 9 – Legal guarantees
In accordance with legal provisions, all physical products benefit from the following guarantees:
- Legal guarantee of conformity (articles L217-4 and following of the Consumer Code): 2 years from delivery
- Guarantee against hidden defects (articles 1641 to 1649 of the Civil Code): 2 years from discovery of the defect
In the event of a defect covered by these legal guarantees, return costs are borne by GuitarScaler.
Article 10 – Liability
GuitarScaler is only bound by an obligation of means in the context of online sales. Its liability cannot be engaged for damages resulting from the use of the internet (data loss, intrusion, viruses, service interruption).
GuitarScaler cannot be held responsible for the non-performance of its obligations in the event of force majeure, understood as any unforeseeable, irresistible and external event, in particular: strikes of postal or transport services, natural disasters, pandemics, or technical failures beyond its control.
For purchases for professional use, GuitarScaler expressly excludes any liability for indirect damages, loss of revenue or profit.
Article 11 – Intellectual property
The GuitarScaler brand is registered with the Institut National de la Propriété Industrielle (INPI). All elements of the guitarscaler.com site are the exclusive property of GS GUITARSCALER, including without limitation:
- The logo and graphic charter
- Texts, descriptions and editorial content
- Photographs and produced visuals
- Demonstration videos
- Educational content of the Jam Sessions training
Any reproduction, exploitation, redistribution or use, even partial, of these elements is strictly prohibited without prior written agreement from GS GUITARSCALER. Any hyperlink to the site is subject to express authorization.
Article 12 – Personal data protection (GDPR)
12.1 Data controller

12.2 Data collected and purposes
The personal data collected (surname, first name, postal address, email address, browsing data) are used exclusively for:
- Processing and delivery of orders
- Customer relationship and after-sales service management
- Sending commercial communications (with consent)
- Improving user experience on the site
- Compliance with legal and accounting obligations
12.3 Legal basis
Processing is based on: performance of the contract (order processing), consent (marketing communications, non-essential cookies), and legal obligation (invoicing, archiving).
12.4 Subcontractors and recipients
As part of its activities, GuitarScaler uses the following subcontractors, all compliant with GDPR:
- Shopify Inc. (shop hosting, Shopify Payments) — servers that may be located outside the EU, covered by the European Commission's standard contractual clauses
- Tevello (hosting of the Jam Sessions training)
- PayPal (payment)
- Meta Platforms (Meta Pixel — advertising measurement)
- Google LLC (Google Analytics, Google Tag Manager — audience measurement)
- Shopify Messaging (customer communications)
12.5 Retention period
Data is retained for the duration of the contractual relationship, then 3 years for commercial prospecting purposes (with consent) and 10 years for accounting documents in accordance with legal obligations.
12.6 Rights of individuals
In accordance with GDPR (EU Regulation 2016/679), every Customer has the following rights: access, rectification, erasure, limitation of processing, portability, opposition and withdrawal of consent. These rights can be exercised by email at contact@guitarscaler.com or via https://guitarscaler.com/pages/contact. In the event of an unresolved complaint, the Customer can contact CNIL (www.cnil.fr).
12.7 Cookies
A cookie consent banner is active on the site. Non-essential cookies (audience measurement, advertising) are only deposited with the prior consent of the Customer.
Article 13 – Customer reviews
The reviews displayed on guitarscaler.com are collected in two ways:
- Reviews solicited directly from verified buyers via tools integrated into the store

Spontaneous testimonials transmitted directly by customers
All published reviews come from buyers who have actually ordered a GuitarScaler product and are subject to prior verification before publication. The date of collection and any update of reviews is retained. GuitarScaler does not publish unverified or paid reviews, in accordance with decree no. 2022-582 of April 20, 2022.
Article 14 – Archiving and proof
GuitarScaler archives order forms and invoices on a reliable and durable medium. GuitarScaler's computerized records constitute proof between the parties as evidence of communications, orders, payments and transactions that have occurred.
Article 15 – Consumer mediation
In accordance with articles L612-1 and following of the Consumer Code, in the event of a dispute not resolved amicably with GuitarScaler, the consumer Customer may use mediation free of charge via:

Article 16 – Force majeure
GuitarScaler cannot be held responsible for any delay or non-performance resulting from a case of force majeure, understood as any event independent of the will of the parties, unforeseeable and irresistible within the meaning of article 1218 of the Civil Code, in particular: natural disasters, epidemics, total or partial strikes of postal and transport services, fires, floods, or computer system failures.
In the event of force majeure, GuitarScaler will inform the Customer as soon as possible and will endeavor to find an alternative solution. If the impediment lasts more than 30 days, each party may terminate the contract without compensation.
Article 17 – Dispute resolution
These T&C are subject to French law. In the event of a dispute between the parties, they undertake to seek an amicable solution before any legal action.
For disputes with consumers (B2C), the competent jurisdiction is that of the consumer's domicile, in accordance with applicable rules.
For disputes with professionals (B2B), in the event of failure of the attempt at amicable settlement, the parties grant exclusive jurisdiction to the Commercial Court of Toulon, notwithstanding plurality of defendants or third-party claims.
Applicable international conventions, in particular the Vienna Convention on the International Sale of Goods, are expressly excluded for sales to consumers. For sales to professionals outside France, French law applies exclusively.
